STILL ON AJAOKUTA LIBREATION STRUGLES

I bring to you, in the links below, the exact modified contract signed on the 1st August 2016 by Min. of Solid Minerals and GINL on the re-concession of #NIOMCO Itakpe. https://www.dropbox.com/…/GINL%20Modified%20Concession%20-%… I have also included in the second link below the proposed modified contract of NIOMCO which AGF Adoke wanted so badly for president #Jonathan to sign way back as December 2014. https://www.dropbox.com/…/GINL%20Modified%20Concession%20-%… OBSERVATIONS!!! 1.On the 12th Dec. 2014, Adoke submitted to Jonathan the Modified concession contract for approval. On the 7th January 2015, the approval was given. (Refer to paragraph 8VII in page 5 {page 6 in faded pencil} ). The only reason why NIOMCO was not handed over to the Indian GINL was because the then Minister of Mines and Steel Arch. Sada refused to sign. According to Sada, the terms of the contract were not in favor of Nigeria. That how could he by his own hands, take Nigeria back to the state Yar'Adua saved her from. Adoke was not happy Sada defied presidential order and did everything he could to ensure the modified contract was signed before the elections (which ushered Buhari). Sada did not sign. 2. The Adoke's 2014 concession contract and Fayemi's 2016 concession contract ARE EXACTLY THE SAME. NO DIFFERENCE WHATSOEVER apart from changing the ministry's name from Mines and steel to solid minerals. Fayemi's link opens to the first page of the contract while Adoke's starts on page 1 (page 10 of faded pencil) right after the presidential summary. 3. Plagiarism was the order of Fayemi's contract. He copied everything Adoke wrote including the typographical error committed in page 9 section 7.1.2 where COMPLETE should have been COMPETE to make sense. 4. Fayemi said a number of times and most recently on Channels Television that he was able to save Nigeria from paying between $500 to $700m. My people, please turn to page 3 of Adoke's memo to Jonathan (set of pages before the modified contract) and read where Adoke wrote that he was able to negotiate zero damages and a waiver of $525m on behalf of Nigeria. He called it a substantial achievement. What baffles me is that Adoke in the same page 3, made reference to a PRESIDENTIAL COMMITTEE that estimated the $525m damages payable to GINL. That means the amount was generated IN NIGERIA and NOT the London ARBITRATION COURT. Who are the members of that presidential committee that overlooked the findings of Inuwa Magaji's report? What parameters were used by the committee to quantify damages worth $525m to GINL? (I bought a tuber of yam for 1 million naira. Once you are paid, give me 200k, give Mr. B, 100k, Mrs C 50k. Or, If Nigeria does not pay but gives NIOMCO to you, we shall settle profit from the sales of Iron Ore...remember me o) 5. Fayemi also said that he was able to negotiate a higher profit % for Nigeria. Please check pages 7 section 5 of the two contracts under CONCESSION FEE and you shall see that the 4% was agreed way back in 2014. 4%???? Na wah. 6. Did uncle Fayemi say the Indians were here for only 7 years to complete their 10 years initial term??? Please turn to page 6 section 4 of Fayemi's under COMMENCEMENT and DURATION (the same in Adoke's). THERE IS AN OPTION TO RENEW FOR ANOTHER 10 YEARS. Every lawyer knows that that clause is always exercised. So Nigerians, brace yourself for 17 years of GINL in our lives. How old will I be then, may my children not waste an energy fighting this mess because he who fights and runs away, lives to fight another day. 7. GINL is asking Nigeria to pay for the DETERIORATION OF EQUIPMENT which occurred during the 8 year pendency of the arbitration!!! Please check page 6, section 4A (b). Nigeria is also going to pay to rehabilitate NIOMCO back to the state it was in 2008, pay for any missing documents and design etc. Please read the CONDITIONS PRECEDENT section very well. The commercial agreement to settle the condition precedent is that if Nigeria fails to undertake the repairs, GINL shall do so and pass the bills to Nigeria. An estimate of the rehabilitation cost was arrived at €500m (500 million euros). Nigerians, don't you see that this is still another form of extracting the $500- 700m uncle Fayemi talked about? 8. Section 7 which contains obligations of Grantor (Nigeria) gave me headache. It contains Nigerias duties to GINL in the course of their operations. I need explanation to some requests like - 7.1.14 are they saying NIOMCO will not pay electricity bill??? 7.1.15 is Nigeria to provide for GINL's security from the host communities? 7.2 (b) GINL is to benefit from ALL fiscal incentives, tax exceptions and even export charges when selling our ore overseas but will sell Iron Ore to ASCL at normal commercial price (see 8.1.22 on page 13) So very many more to direct and digest my beloved Nigerians. Read and understand why Sada refused to sign. Dear Uncle Fayemi, From the foregoing, it is clear that all these times you appeared before the National Assembly, television and newspaper saying "you were working very hard " to resolve the arbitration which held our common resources captive in the hands of GINL, you sir, actually DID NOTHING. Sir, if you had known that you were still going to COPY and PASTE what ex AGF Adoke did way back in 2014, why didn't you just save Nigerians the time and execute this way back as January. Look around you sir. Nigerians are suffering and WASTING OUR TIME IS A CRIME AGAINST US. Moreover sir, I would like to know what your so called numerous meetings to London, wasting our scarce resources, were all about. You surround yourself with so many aids, paying them way above the minimum wage my cousin Mary who is a cleaner in Kogi state government house receives yet THEY COULD NOT EVEN DISCOVER THE TYPOGRAPHICAL MISTAKE IN ADOKE'S CONTRACT. Na wah. Do you people read at all? Do you work with the interest of Nigeria FIRST? Lastly sir, this findings have only proved one thing... that indeed there is a SYSTEM also known as the "Cabals" who stay behind the scenes and control the national affairs. Its was this same SYSTEM that had Adoke draft and push hard the modified concession which you also pushed to complete. Like PLUG and PLAY mechanism. The system is so strong , it looks for who to devour. Sir, you are part of an administration that preaches CHANGE. Only God knows how much I love president Buhari but it breaks my heart to see that some of the people he trusts DO NOT share the same vision of change as he does. Like seriously??? Executing the same thing, word for word that the past administration drafted??? I think it would be appropriate if you start giving credit to AGF Adoke or referencing him in your interviews because THAT WAS HIS WORK. As unpleasant as the terms are- ITS ADOKE's work!!!. Anyway, I like millions of Nigerians have seen now that Ajaokuta and Itakpe are controlled by strong forces who treat same as their personal possession. DO NOT FORGET THAT GOD and the PEOPLE are GREATER than the SYSTEM. I shall let this be now while I focus on seeing that THE PRESIDENT'S INITIAL ORDER on Ajaokuta is executed. Let me remind you sir and I quote from the memo: No. PRES/97/HAGF/21 b) schedule thereafter, a composite meeting involving the Russian Company TyazhPromExport Company (TPE), and or a separate meeting with the company, for the purpose of finalizing the discussion of the Russian proposals for the reactivation of the Ajaokuta Steel Company Limited. Sir, You can call ICRC, BPE and any due process body you want to over look the ASCL biddings. You will not deprive Nigerians anymore progress. NO NO NO . 22 years since the Russians left and we are yet to fill the big shoes they left in Ajaokuta and you want to take us for another looooonng ride. NO NO NO. NIGERIANS ARE FED UP WITH ADMINISTRATIVE GIMMICKS. We want economic justice to our God given resources and national assets so we can be out of poverty. Lastly sir, our time with our beloved president Buhari is limited, please let us enjoy maximum progress under his administration. Do not stall his vision for Nigeria. I BEG OF YOU.
